The military police will be able to break into the homes of law violators: in particular, evaders

The draft law on the military police, which is currently being considered by the Rada, introduces the possibility of informing on evaders and deserters for money. They can also break into the apartments of violators of military law. 


Article 9 of the draft law contains a provision according to which the military police may “cooperate with individuals, in particular on a contractual basis, observing the conditions of voluntariness and confidentiality of these relations, materially and morally encourage persons who assist in the prevention, detection, and suppression of criminal offenses.”


Although this article does not specifically mention evaders, lawyers interviewed by TSN believe that it most likely refers to them.


The draft law wants to give military police the right to enter the homes of violators of the law on military service in certain cases. This includes, in particular, evaders. 


“In urgent cases related to saving lives and property or the direct prosecution of persons suspected of committing a crime, in cases and on the grounds provided for by law, to enter a person's home or other property with immediate notification of the pre-trial investigation body and the prosecutor's office,” the draft law states. 


“Given that the draft law provides for amendments to the Administrative Code, taking into account the purpose of creating the military police, I can assume that it is the military police that will conduct operational and search activities against evaders who have not updated their military registration data, have not registered for military register, who have been declared wanted and have not appeared in the TCC,” said lawyer Kateryna Anishchenko.
