Up to 200 thousand hryvnias or imprisonment: new fines and penalties for evading mobilization in Ukraine

In the near future, Ukraine intends to strengthen responsibility for evading mobilization and other military offenses. This is stated in draft law No. 10379, which is published on the website of the Verkhovna Rada.


The government proposes to amend the Administrative and Criminal Codes, including a significant increase in fines for violating military regulations.


For example, the fine for violation of military registration rules (e.g., evasion of registration) may increase from five hundred to one thousand tax-free minimum incomes (UAH 8,500 to 17,000), compared to the current UAH 3,400 to 5,100.


Fines for violations of the legislation on defense, military duty and military service, mobilization training and mobilization of citizens may range from UAH 25,500 to 34,000, and for officials - from UAH 34,000 to 85,000.


During the special period, violations of this legislation are subject to fines of UAH 34,000 to 51,000 for citizens and UAH 153,000 to 204,000 for officials.


It is also possible to detain persons who violate the law during the special period for up to three hours to draw up a report and up to three days, if necessary, to identify the person and/or clarify the circumstances of the offense.


Currently, mobilization evasion is punishable by three to five years in prison, but the new amendments may extend this penalty to citizens who refuse to undergo a medical examination.
