Zelenskyi instructed to strengthen criminal liability for improper maintenance of shelters

Zelenskyi instructed to strengthen criminal liability for improper maintenance of shelters

The President of Ukraine, Volodymyr Zelenskyi, instructed to strengthen criminal liability for improper maintenance of shelters and failure to provide access to them.

 This is reported by RBC-Ukraine with reference to Decree No. 353.

 The NSDC recognized the unsatisfactory work of ensuring the readiness of shelters for their intended use in the cities of Kyiv, Zaporizhzhya, Kherson, Chernihiv, Kharkiv, Mykolaiv, Odesa, Sumy, Dnipro, Konotop, Bila Tserkva, as well as in Zaporizhzhya and Sumy regions, Zhytomyr district of Zhytomyr region , Belotserkiv district of Kyiv region and Konotop district of Sumy region.

 In view of this, the Cabinet of Ministers, regional and Kyiv city military administrations and local self-government bodies should take immediate measures to bring to disciplinary responsibility managers and other officials responsible for the maintenance and operation of shelters in settlements where the situation is recognized as unsatisfactory.

 The NSDC Apparatus should be informed of the results of the measures taken by June 30.

 What should the Cabinet of Ministers do?

 By July 31, the government must submit to the Verkhovna Rada proposals for changes to:

  •  of the Criminal Code - regarding the strengthening of the criminal liability of officials for improper maintenance and operation of shelters and for not providing the population with unhindered round-the-clock access to them;
  •  of the Code of Ukraine on Administrative Offenses - regarding the establishment (strengthening) of the responsibility of officials, balance-keepers (owners) for improper maintenance, operation and failure to ensure round-the-clock access of the population to shelters;
  •  of the Law of Ukraine "On Liability for Offenses in the Field of Urban Planning" - on establishing the responsibility of urban planning entities for improper design and construction of protective structures of civil protection.

In addition, a number of tasks have been defined for the Cabinet of Ministers. In particular:

 the government should determine the status of shelters as having strategic importance for ensuring the protection of the population;

 to identify an official from the Cabinet of Ministers who will coordinate and control the process of bringing objects to their proper condition;

 ensure the implementation of systematic measures to check the condition of shelters;

 to create a commission headed by the Deputy Prime Minister for Reconstruction - the Minister of Community Development, Territories and Infrastructure to check the condition of bridge structures.

 In addition, the regional and Kyiv city military administrations have:

 ensure that by June 30, the objects that cannot be used by the population for shelter are removed from the electronic maps of shelters;

 to bring the existing shelters into proper condition by July 25, to ensure round-the-clock and unhindered access to them;

 take measures to increase the fund of shelters to ensure access to them for 100% of the population.

 Tragedy in Kyiv

 And on the night of June 1, the Russians hit Kyiv with ballistic missiles, and the Ukrainian military shot down all air targets.

 However, rocket fragments fell near a polyclinic in the capital's Desnyan district, where people could not get to the shelter. Two women and a child died as a result of the incident.

 After that, four people were detained - the first deputy of the Desnyansk RDA, the director of the medical facility and his deputy, as well as a security guard.

 In addition, the court sent Roman Tkachuk, director of the municipal security department of the KMDA, under 24-hour house arrest.

 After the incident, inspections of all shelters began in Ukraine. On June 23, a meeting of the NSDC took place, at which the results of the inspections were discussed. Zelenskyi announced personnel decisions.
