The Commercial Court of Kyiv ordered the demolition of the "MAF temple" on the territory of the Museum of the History of Ukraine. It was built there illegally.
This was announced by the Minister of Culture Oleksandr Tkachenko in his Telegram channel.
"The museum's claim has been satisfied. Placing this building on the museum's plot of land contradicts its intended use," he said.
According to him, this violates the requirements of Clause a, Part 1 of Article 91 of the Land Code, which stipulates that any building must be used for its intended purpose.
Tkachenko also reminded that the "MAF temple" is located in the buffer zone of UNESCO monuments, where new construction is prohibited, besides, it violates the ensemble of the historical archaeological complex "Desyatynna Church".
The court's decision will enter into force in 20 days, if no appeal is filed against it.
In a comment to the mass media, the director of the museum, Fedir Androschuk, noted that the church will most likely file an appeal against the court's decision. However, he is confident of victory.
"I think that the church will be demolished in the near future - this year for sure. Otherwise, it will create a situation of uncertainty," he explained.
In 2004, the head of the museum, Serhiy Tchaikovskyi, granted permission for the construction of the "MAF temple" near the Tithing Church to the UOC MP community. In 2012, the community acquired ownership of the building, while the land remained in the possession of the museum. In 2021, the museum filed a lawsuit demanding the demolition of the temple on its territory.
