Creation of the Special Tribunal will make it possible to bring to justice for crimes related to the military aggression of Russia - Venediktova

In order to prosecute specific individuals for acts of military aggression on the territory of Ukraine, it is important to create a special Tribunal, emphasizes Prosecutor General Irina Venediktova.

 

"There is a UN court in The Hague, which you and I have been watching since Monday (on March 7, the International Court of Justice began hearings in the case of Ukraine's lawsuit against Russia on charges of genocide) and the International Criminal Court (ICC). The competence of the UN court is to prosecute states, while the ICC prosecutes specific individuals," the prosecutor general said at a press conference in Lviv on Wednesday.

 

She recalled that Ukraine is not a state party to the Rome Statute, but 39 countries did it for Ukraine and appealed to the ICC.

 

"Now the investigation has just begun," Venediktova noted.

 

She stressed that the Office of the Attorney General has been cooperating with the ICC prosecutor's office for a very long time, more than 20 applications have already been filed.

 

"We can't say that we will get an ICC decision quickly. First there will be an investigation, then there will be a trial," added the prosecutor general.

 

Venediktova explained that the ICC competence is war crimes, crimes against humanity.

 

In this context, the prosecutor general said: "Ukraine and Russia are not parties to the Rome Statute. Therefore, crimes of aggression cannot be considered by the ICC, which is the most important thing for us. That is why there is a question of the possible creation of a Special Tribunal".

 

"We hope that some separate international institution will be held accountable for the crimes of aggression," Venediktova concluded.
