The new draft law on mobilization provides for the seizure of bank accounts of evaders by court order after a request from the territorial center for recruitment and social support.
It provides for three main penalties for conscripts:
- temporary restriction on the right to leave Ukraine;
- temporary deprivation of the right to drive vehicles;
- seizure of money and other valuables held in accounts and stored in banks or other financial institutions.
The application is filed with the court of first instance within five days from the date of the violation, namely, if the citizen fails to appear at the TCC within ten days from the date of delivery of the request.
They plan to block the accounts of even those tax evaders who are abroad, as failure to appear at a "foreign diplomatic institution of Ukraine if the citizen is abroad" will be considered a violation.
The court must make a decision on the merits of the claims no later than 15 days from the date of opening the proceedings. Its decision is subject to immediate execution, although it may be appealed to the appellate instance.
Enforcement proceedings to freeze accounts will be subject to termination only after the TCC withdraws its claim.
The draft law stipulates that all citizens registered for military service are obliged to clarify their address, contact numbers, email addresses and other military registration data within 60 days of the law's publication. This can be done through administrative service centers, an electronic cabinet or a TCC.
