Cabinet of Ministers submits draft law to toughen penalties for violation of military registration rules: criminal responsibility for refusing medical check-up

Along with the draft law on mobilization, in late December the Cabinet of Ministers submitted draft law No. 10379, which aims to increase responsibility for violations of military registration and mobilization law.


The main proposals of the draft law include a 10-fold increase in fines for violating the rules of military registration, which will now range from UAH 8,500 to UAH 17,000. Fines for violations of the legislation on defense, military duty and military service, mobilization training and mobilization will range from UAH 25,500 to 34,000 for citizens and from UAH 34,000 to 85,000 for officials. During the period of special conditions, fines increase to UAH 34,000 to 51,000 for citizens and UAH 153,000 to 204,000 for officials.


In addition, it is proposed to introduce criminal liability for refusing a medical check-up and consider it as evasion of the draft during mobilization. The draft law also provides for the possibility of detaining violators of the mobilization law for up to three hours to draw up a report and up to three days in "necessary cases" to identify the person and/or clarify the circumstances of the offense.


If this draft law is adopted in the proposed form, it may make it impossible to appeal against the protocols for violations and create space for corruption and abuse.
