"Individuals' deposit guarantee fund succeeded in seizing the assets of the owner of JSC "Bank "Finance and Credit" Konstantin Zhevago as part of securing a claim for compensation of losses of the Bank and its creditors in the amount of almost UAH 46 billion. The corresponding decision was taken by the Economic Court of the city of Kyiv on the Foundation's application to secure the claim," the message says.
It is reported that in making this decision, the court "considered the confirmation provided by the Fund that the defendant had been trying in various ways for a long time to hide the fact of ownership of the property belonging to him, due to which in the future the Fund's claims against Konstantin Zhevago may be satisfied."
As a result, the court reportedly seized the following assets:
• part of corporate rights in the amount of 50.3% of the authorized capital of PJSC Poltava Mining and Processing Plant;
• part of corporate rights in the amount of 50.3% of the authorized capital of Eristovsky mining and processing plant LLC;
• part of corporate rights in the amount of 50.3% of the authorized capital of Belanovsky mining and processing plant LLC.
It is noted that these shares "indirectly belong to Konstantin Zhevago through Ferrexpo Ag".
In addition, the court prohibited other companies connected with it from alienating the specified assets.
"Currently, the Fund's claim against the owner of the bank is in the first instance in the Ukrainian jurisdiction, and it is extremely important that during the consideration of this case the assets were preserved in full and could subsequently be directed to compensation for losses caused to the bank's creditors," commented the deputy director- Fund manager Viktor Novikov.
