On Monday, Ukraine called on the UN member states to resume the application of the UN Charter in the issue of the legitimacy of the Russian Federation's presence in the UN, to deprive the Russian Federation of its status as a permanent member of the UN Security Council and to exclude it from the UN in general. This is stated in the statement of the Ministry of Foreign Affairs of Ukraine.
The Ministry of Foreign Affairs reminds that the issue of Russia's membership in the United Nations, as well as its stay in the UN Security Council, was not properly settled in accordance with international law.
"Russia mistakenly considers the issue settled, referring to the fact that since December 24, 1991, and in the public domain - since December 31, 1991, a sign with its name appeared in the UN Security Council. In fact, according to the UN Charter, this is not there were and still are no legitimate grounds," the statement emphasizes.
In particular, the foreign policy department draws attention to the fact that the UN Charter does not contain the words "Russian Federation", and the country did not go through the procedures and steps for acquiring membership provided for by the document - as, for example, the Czech Republic and Slovakia did after Czechoslovakia ceased to exist.
"Thus, the Russian Federation never went through a legitimate procedure for acquiring membership and occupies the place of the USSR in the UN Security Council illegally. From a legal and political point of view, there can be only one conclusion: Russia is a usurper of the place of the Soviet Union in the UN Security Council," - the Ministry of Foreign Affairs notes .
The statement states that neither the agreement of the group of countries of the former Soviet Union, nor the opinion of the legal adviser of the UN Secretariat can replace the current Charter of the Organization and could not "serve as a basis for tacit agreement on the admission of Russia as a member neither for the UN Secretariat nor for the UN member states , including members of the Security Council".
"In fact, it was an unprecedented case in the history of the UN, when a country imposed its membership in the Organization by a unilateral decision, and UN member states were deprived of the statutory right to express their position by voting in the General Assembly on the RSFSR's desire to gain membership in a way that not provided for by the Statute". - Emphasizes the department.
The Ministry of Foreign Affairs also reminds that the actions of Russia as a permanent member of the UN Security Council and a member of the UN in general do not correspond to the principles of pacifism and peacekeeping, citing as examples the aggression against Ukraine, Moldova, Georgia, the Republic of Ichkeria, interference in the internal affairs of the countries of the Baltic-Black Sea region, abuse the right of veto in the Security Council, etc.
The department notes that the exclusion of Russia from the UN Security Council and the Organization as a whole should be decided by all UN members, and in addition, it should not lead to the annulment of decisions made during Russia's membership in the Organization.
"Ukraine initiates a comprehensive process aimed at achieving the goals of this statement, and in this context is ready to cooperate with other countries to jointly protect the UN Charter and international law from the destructive influence of the Russian Federation," the Ministry of Foreign Affairs emphasizes.
