From January 1, Ukrainians will have the right to legally return goods that they bought from "FOPs" (physical persons-entrepreneurs). This will be possible due to the requirement to issue fiscal checks, not just "papers", reports Obozrevatel.

Such fake receipts are now printed by many entrepreneurs, and when it comes to the return, for example, of faulty equipment and gadgets, they are not accepted back. Moreover, this way the Ukrainians are freely sold contraband goods.

As a result, the consumer is the most unprotected side of economic relations. This was said by an MP, the head of the Verkhovna Rada Committee on Finance, Tax and Customs Policy Daniil Getmantsev.

"Our consumers do not and have never had the right to a check. All over the world there has been, but we haven't. I mean a fiscal receipt, the issuance of which is fixed by the state, not a piece of paper that can be refused the next minute after it is issued," Hetmantsev wrote.

The absence of such a rule, he said, was justified by the alleged concern for small and medium-sized businesses. As a result, this business was given the opportunity to systematically evade taxes and at the same time turned it into Europe's largest channel for the sale of contraband without documents.

"Ostensibly taking care of the ease of running an already more than preferential (2nd and 3rd groups of the single tax) small trade business, we opened the gates to the illegal trade, which is essentially completely in the shadows. And a teacher or a doctor, buying a computer for his child with the money saved by hook or by crook from his paltry salary, from which, by the way, in contrast to the trader pays the full amount (19.5%) of income tax, can present their claims for quality goods, equipment, etc. only if he got an honest salesman who cares about his reputation. Otherwise, the state will not protect him," the deputy explained.

He sees corruptive reasons in it. The fact is that it is not small business that sells contraband goods for "black money" through "FOPs", but big businessmen. They are "covered up" by tax and customs officials, who thus receive additional income from the subsequent sale of the fraudulent VAT in "twists".

"The income, which they subsequently use... also to lead people to protests against the government's policy of imposing order, referring to the fact that the government is killing small and medium-sized businesses by introducing compulsory EDR," Hetmantsev added, referring to the recent protests of "FOPs" against the introduction of mandatory registrars of settlement transactions (EDR).

The deputy assured that the business of an honest "FOP" trading goods will not suffer from the introduction of EDR. But smugglers, cheaters and tax evaders will suffer.

Now, from January 1, every trader will be obliged to issue a fiscal, and therefore registered in the tax office check. The only exceptions will be the "FOP" of the 1st group on a single tax and the "FOP" in the villages.

"Every teacher, locksmith, military man, entrepreneur, as well as any other consumer, when buying a product, has the right to demand a fiscal check, and in case of refusal to complain to the tax office. Failure to issue a fiscal check is grounds for termination of the transaction and for the liability of the entrepreneur, who did not issue a check," said Getmantsev.

He clarified that such rules exist in developed countries. As a result, according to the MP, every consumer of all 40 million Ukrainians will also be protected as of January 1, 2022.
