Ukrainians may be fired from their jobs if they fail to inform their employers about relatives or other close people living in the TOT or in the Russian Federation. The relevant draft law was adopted yesterday in the second reading by the Verkhovna Rada.
The bill itself was registered in 2022 by a group of MPs from the Servant of the People faction.
Obligations were added to the rules of internal labor regulations, for violation of which a person can be fired:
- Employees must provide information about their ties to individuals whose place of permanent residence (stay, registration) is located in the territory of the aggressor state or the temporarily occupied territory of Ukraine;
- Employees' obligation not to disclose restricted information, including information constituting a state or commercial secret, as well as the conditions of work with confidential information.
The employer will be able to dismiss an employee for failure to comply with the rules mentioned above.
It is emphasized that the establishment of rules of conduct at enterprises, institutions, organizations of strategic importance for the economy and security of the state, and/or critical infrastructure facilities or operators is mandatory.
The Law also provides for one more new reason for an employer to suspend an employee from work, namely: "Conducting an official inspection by an employer included in the list of state-owned objects of strategic importance for the economy and security of the state and/or critical infrastructure facilities or operators".
At the same time, the Labor Code does not contain a definition of the term "official inspection". In addition, the draft law does not specify the specific issues that may be checked by the employer and result in the employee's dismissal.
The Main Legal Department of the Verkhovna Rada criticized this provision. It is believed that it violates the Constitution and may lead to unlimited interpretation, which would violate the rights of employees.
