On Thursday, the Council of Europe published an annual report on the implementation of decisions of the European Court of Human Rights by the member states of this organization.
In particular, the document states that by the end of last year, more than six thousand ECtHR decisions were expected to be implemented, 2,352 of them, that is, about 40%, fell on Russia. The Committee of Ministers of the Council of Europe, which monitors the implementation of court decisions, received 413 new ECtHR decisions last year, of which only three were implemented.
According to the decision of the ECtHR, Russia is expected to pay compensation in 1,102 cases, and the total amount of compensation unpaid by the Russian authorities exceeds 2 billion euros, of which more than 1.8 billion is due to compensation in the case of Yukos and 10 million in the case of Georgia v. Russia . It concerns the payment of compensation to Georgian citizens deported from Russia in the fall of 2006.
"We emphasize with deep regret that the Russian authorities, despite the signing of the Memorandum of Understanding on December 17, 2021, which provides for the possibility of payment (in the case of Georgia v. Russia") of fair compensation through the bank account of the Council of Europe, has not paid as of the end of 2022. ", the document says.
The Committee of Ministers of the Council of Europe suggested that the authorities of the member states "study all possible means of ensuring the implementation of this matter." The organization's secretariat is tasked with creating and publishing a register of just compensation in all interstate cases against the Russian Federation, as well as regularly updating it.
The ECHR ordered Moscow to pay 10 million euros to the Georgian side at the beginning of 2019. Persons who suffered as a result of the violation of Article 4 of Protocol 4 of the European Convention on Human Rights (prohibition of collective expulsion of foreigners) should receive 2,000 euros each. The Russian state is obliged to pay from 10 to 15 thousand euros to citizens who were violated at the same time, points 1 of Article 5 (illegal deprivation of liberty) and Article 3 (inhuman and degrading treatment/detention).
Last March, Russia was expelled from the Council of Europe due to its aggression against Ukraine. On September 16, it officially ceased to be a member country of the European Convention on Human Rights. However, the Council of Europe emphasizes that it is obliged to comply with the decisions of the ECtHR issued in cases decided by the court for consideration by September 16, 2022. However, in March of last year, Moscow stopped both implementing ECtHR decisions and reporting on their implementation.
